Bong’s lawyer: Senate violated Napoles’ right

MANILA, Philippines – The camp of Sen. Ramon Revilla Jr. yesterday expressed concern that the Senate may have committed a “brazen violation” of Janet Lim-Napoles’ constitutional right to presumption of innocence when some senators insinuated that she could be guilty in the alleged pork barrel scam.

Joel Bodegon, legal counsel of Revilla who is one of three senators facing plunder in connection with the scam, also decried the trial by publicity generated by the Senate Blue Ribbon committee’s probe on the pork barrel issue last Thursday.

“The sad thing is that the investigation was a brazen violation of Janet Napoles’ constitutional right to presumption of innocence as most of the senators already condemned her guilty without the benefit of trial,” Bodegon said.

The first step is to start listening to her mate. She need not flare up or show her disapproval if she does not agree to what he has to say. Instead, she must accept at face value his statements. Don’t push yourself on him. But let him believe that you have come to him because you wanted it. This anyway is true. 

Don’t try to change your man
It is important that you stop trying to change your mate. This is one mistake that most spouses make. They think that their men will change if they keep after them. Nothing can be more counterproductive. Constant nagging only leads to revolt and rebellion. Also, stop blaming your mate for anything and everything that has gone wrong in the relationship. It will only make him fight back.

You must not sound or look dishonest when you are trying to salvage the relationship. It is essential that you have full belief in what you are doing. You should gradually make him talk of why he had starting moving away from you. Once again, you don’t have to push him into talking about his misgivings. If you are suffering from any nervous disorder, you should not play it; if you are not yet ill you should not play it; if you are feeling melancholy you should not play it.”

Invented by the Russian inventor Leon Theremin in the 1920s, the instrument is outfitted with two antennae and when the hands of the player enter the electrostatic field around each antenna, changes in pitch and volume occur.

For years the Theremin enjoyed cult status in sci-fi movies (such as Bernard Herman’s score for the 1951 classic The Day the Earth Stood Still) and it is still used today in movies and by a number of contemporary musicians including bands such as Led Zeppelin, Radiohead and Portishead. In fact the Theremin is enjoying a veritable musical renaissance!

Dating After Loss of a Spouse

When a relationship ends due to one partner dying, what is the correct time period to begin dating again? Grief is such a funny, unpredictable animal. Many people in years’ past think a year is a suitable time to wait before incorporating life changes, and yet for many of us, a year into our loss – we’re barely getting started on our grief journey. My experience has been that people and perhaps society as a whole, do not allow enough time or thought to the actual grief process. There is no quick fix or “getting over it” and moving on. We all move through grief in our own ways and means. There is nothing by formula that we can follow or hope to happen. Talking with others who have experienced a similar loss is definitely a plus.

Some days the road is more difficult than others days. At times, you feel enveloped in a mist of uncertainty. Even small decisions can sometimes stretch past your point of coping.

Personal decisions are just that, personal. What is suitable for anyone must be decided individually. Sometimes you have to let go of preconceived notions of the correct way to act and grieve. 

I began dating too early, about a year after my husband passed away. I was incredibly lonely and in a real oxymoron, I was determined to be happy again, at any cost to myself. So, I started dating through online sites and I kept attracting the wrong type of man. Takers, emotionally unavailable, surface daters, serial daters, men who mirrored my own uncertainty about my readiness to date again.

Court of Appeals clears ampatuan clan, cohorts on rebellion raps

The Ampatuan clan has been absolved by the Court of Appeals from rebellion charges, including its patriarch Andal Ampatuan Sr., former ARMM Governor Zaldy Ampatuan and several others.

This was after the appellate court junked the petition for review filed by the government, through the Office of the Solicitor General (OSG), questioning a Quezon City court decision dismissing rebellion raps against them in connection with the Maguindanao massacre in 2009.

The setback from the government came after the CA has affirmed the findings of Quezon City RTC in exonerating the Ampatuans and their cohorts.

In a 63-page decision, penned by Associate Justice Elihu Ybañez, the appeals court upheld the March 2010 ruling rendered by Judge Vivencio Baclig of Quezon City Regional Trial Court Branch 77 finding no probable cause to indict the clan for the said crime.

The CA blamed the prosecution for the weak case against them, saying that “a judge or fiscal may not go on with the prosecution in hope that some credible evidence might later turn up during trial. The prosecutors may have indeed abuse the criminal justice system.”

The lower court decision had held that there exists no probable cause to indict the accused.

Aside from Andal Sr. and Zaldy Ampatuan, also cleared  by the CA were Datu Anwar Ampatuan, Datu Sajid Islam Ampatuan, Datu Akmad Tato Ampatuan.

The CA also cleared the Ampatuan allies Akmad Abdullah Ulilisen, Kusain Akmad Sakilan, Duca Lendungan Amban, Jovel Vista Lopez, Rommy Gimba Mamay, Sammy Duyo Villanueva, Ibrahim Tukya Abdulkadir, Samil Manalao Mindo, Goldo B. Ampatuan, Amaikugao Obab Dalgan, Billy Cabaya Gabriel Jr., Abdulla Kaliangat Ampatuan, Moneb Samir Ibrahim, Umpa Ugka Yarya, Dekay Idra Ulama, Kapid Gabriel Cabaya, Koka Batong Managilid, Sammy Ganda Macabuat and Manding Abdulkadir.

However, because of the pending multiple murder charges filed against them, the accused will have to stay in jail.

The powerful political kin have been blamed for the massacre of 57 people, where 32 of the victims were journalists in November 23, 2009. The rebellion charges was initially used by the government to arrest the Ampatuans since the murder charges were not yet established by the prosecutors.

According to the CA ruling on rebellion charges, the Department of Justice (DOJ) was not able to prove its claim of rebellion against the Ampatuans and their followers.

The DOJ had accused the Ampatuans of “conspiring, confederating and cooperating with each other… commanded their followers to rise publicly and take arms against the Republic for the purpose of removing allegiance to the government.”

The prosecution said that out of fear of uprising because of the massing of armed supporters who have formed a private army to resist government troops, the functions of the local government were paralyzed as employees went on mass leave.

According to the DOJ, the regional trial courts in the area were not functioning, refused to accept the application for search warrants for violation of PD 1866 to authorize the search of the properties of the heads of the rebellion.

The DOJ also alleged that there was undue delay in the issuance of court processes despite the exigency of the situation.

In spite of this, the CA ruling said that none of the rallyists were armed during the the rally on November 29, 2009 which was attended by ARMM officials from Basilan, Sulu and Tawi-Tawi, in full view of the police and military.

As to the allegations of clashes and gunfires, the appeals court also said that “the accused remind us that the information for rebellion was filed on December 9, 2009, whereas the alleged clashes occurred after December 9, 2009, thereby casting a serious constitutionality infirmity upon the information since the facts constitutive of the crime of rebellion took place subsequent to the indictment.”

“Petitioner (OSG) claims that the rebellion continued from November 24, 2009 to February 2010, yet in contrast, the martial law in Maguindanao was lifted on December 12, 2009, signifying that the rebellion had by then been crushed,” the CA ruling further averred.

The CA also said that even the military dug up thousands of firearms in Ampatuan-owned lots, there were no allegations that these arms had been used against the government.

It added that this also proved that there was no rebellion, for it contravenes claims of undisquised acs of armed uprising to topple the government.

Associate Justices Fernanda Lampas Peralta and Francisco Acosta both concurred with the ruling.

7 SUNDALO PATAY, 21 PA SUGATAN SA ENGKWENTRO SA ABU SAYYAF SA SULU

Ayon kay Lt. Col. Randolph Cabangbang, tagapagsalita ng Armed Forces’ Western Mindanao Command, ang grupo ng ASG na nakasagupa ng mga sundalong miyembro ng Marine Battalion Landing Team 11, ay pinamumunuan ni Radullan Sahiron.

“Reports state that the troops suffered 28 casualties – seven killed in action and 21 wounded in action,” pahayag ni Cabangbang.

“They (soldiers) were fired upon first. Actually, it was an encounter. It’s just incidental that they (Abu Sayyaf) were on the high ground… They (soldiers) entered the enemy camp… They maneuvered the whole night and then in the morning, they were inside the camp,” dagdag niya.

Tinatayang nagsimula ang engkuwentro dakong 4:30 a.m. at tumagal ang palitan ng putok hanggang 9:30 a.m. Hindi pa malinaw kung may nasawi o nasugatan sa panig ng Abu Sayyaf.

Sa press briefing sa Camp Aguinaldo sa Quezon City nitong Huwebes ng umaga, sinabi ni AFP spokesman Commodore Miguel Jose Rodriguez, na maituturing pa ring “strategic victory” ang insidente dahil nakubkob ng mga sundalo ang isang kampo ng Abu Sayyaf.

“Nothing is free,” ayon kay Rodriguez patungkol sa mga casualty. “We understand the nature of our profession. We put our lives on the line so that we can finally rid the country of terrorists and the remain ASG terrorists are concentrated in that area.”
